A federal judge on Tuesday ruled that film studios can be sued for false advertising if they release misleading movie trailers.
The ruling allows a lawsuit against Universal filed by two Ana de Armas fans to proceed, after they paid to rent the 2019 rom-com “Yesterday” believing the actress would appear in it.
Though de Armas appeared in a trailer, her scenes were left out of the final film, in which a struggling musician passes off the Beatles music as his own in an alternate world.
The plaintiffs, Paul Michael Rosza and Conor Woulfe, paid $3.99 each to rent the movie on Amazon Prime, and are seeking at least $5 million as representatives of a class.
